Top Story - Unusual Alliance Propels Free Trade Agreement

Just after Tax Day an agreement was reached in Congress to move forward with Trade Promotion Authority (TPA) so that President Obama may complete the Trans Pacific Partnership (TPP), a landmark free trade agreement with 12 nations in Asia.  The deal came with a unique number of restrictions on the form the TPP must follow, but perhaps the most unusual aspect of the deal is the President's source of support: House and Senate Republicans.

The first comprehensive update since 1986 to the export regulations for nuclear technology at 10 CFR §810 took effect on March 25, 2015. As might be expected given the last time these regulations were reviewed, the changes are extensive. For example, companies with activities that are no longer generally authorized have until August 25, 2015 to apply for specific authorization, and there are new reporting requirements.

There are few items that escape the grasp of the Export Administration Regulations.  Included on the short list of items are books that can be found in a public library.  For this reason government export regulators must be careful about items that go into books that will be widely distributed, and before the item is released.  This article from the New York Times details the travails of Kenneth W. Ford, as he tried to comply with government requests to clear technical details contained in his memoir before the book was published.

Customs and Border Protection

ACE commercial development continues at CBP with a hard deadline of November 1, 2015 for cargo release. At its Software Developer Session held March 27, 2015 in Washington, CBP demonstrated that some of the Participating Government Agencies (PGAs) that are crucial to making ACE a single window for trade are behind schedule. CBP continues to maintain the target November 1, 2015 implementation date.
